State appeals court upholds local man’s murder convictions

WARREN, N.Y. (NEWS10) — A state appeals court is upholding the murder and manslaughter convictions of a Glens Falls man who killed his 15-month-old son.

Gary Waite was convicted of killing his son Jesse Smith back in 2012, telling police he tossed the 1-year-old on the couch, but the child bounced off and hit his head on the floor.

Medical experts said the injuries were too severe to match up with that story. Waite was sentenced to 25 years to life.

His lawyer argued there wasn’t enough evidence to convict him, along with technical issues, but the Court of Appeals is rejecting those arguments and upholding the convictions.
