ALBANY, N.Y. (NEWS10) – The man accused of brutally beating and killing a 63-year-old woman outside the South Mall Towers November 5th has pleaded not guilty.
Albany District Attorney P. David Soares says that 38-year-old Gerard Burks of Albany was arraigned in Albany County Supreme Court Monday morning on a sealed Grand Jury indictment of one count of murder in the second degree. Burks was facing an attempted murder charge but that has now been upgraded.
Burks is accused of causing the death of Lori Milks. Police say security cameras captured Burks stomping on Milks’ face and torso during the attack on November fifth. Milks died from her injured nine days after she was attacked in the area of 101 South Pearl Street.
Police say Burks has been in an out of prison for drug convictions.
Burks has been remanded into custody without bail. No new court appearance dates have been scheduled.
