EUGENE, Ore. (NEWS10) – A federal judge in Oregon ruled that kids can sue the federal government for climate change negligence.
Our Children’s Trust helped the 21 kid plaintiffs, ages nine to 20, file the lawsuit. The organization says the plaintiffs sued the government for violating their constitutional rights to life, liberty, and property and their rights to vital public trust resources, by locking in a fossil-fuel based national energy system with full knowledge of the dangers it posed.
According to the decision, U.S. District Court Judge Ann Aiken rejected arguments to dismiss the case determining “young plaintiffs’ constitutional and public trust claims could proceed.”
The plaintiffs are now preparing for a trial.
