GLOVERSVILLE, N.Y. (NEWS10) – Gloversville Police say a man was found shot to death in a Gloversville apartment after an incident Monday night.

Police responded to a call for shots fired at approximately 11:00 p.m. Monday at an apartment on East Pine Street in Gloversville.

Police say it was an attempted robbery gone wrong.

Jeremy Potter was arraigned on two charges, criminal possession of a weapon and stolen property.

Police say he was at his Gloversville apartment sleeping when two other men who he knows according to police entered his apartment. Gary Terry was also in court and is accused of entering the upstairs apartment with Robert Phillips Jr. with an air soft gun that looks like a real pistol.

Police believe they were looking for marijuana.

According to police, Phillips approached Potter who was sleeping and an altercation ensued between the two.

Police are investigating whether Phillips was accidentally shot during a struggle with a gun or shot intentionally.

Samantha Wilson, a neighbor, said she didn’t hear the gunshots, but once she saw the police presence outside she ran to check on her kids.

“My living room is upstairs, so I got up and made sure my kids were OK, because you never know,” said Wilson. “I don’t know. I don’t know if I would hear it. It’s hard to say, so just checked them and they were OK. They didn’t hear nothing, so it must have been a quiet thing I guess.”

Both men were sent to jail. Terry is being held on 50,000 bail and Potter on 10,000 bail.
