GLENS FALLS, N.Y. (NEWS10) – The case of a man accused of beating a 5-year-old to death in a Glens Falls apartment is now headed to the Supreme Court.
Brandon Warrington was found guilty of murdering his girlfriend’s son, Gary Carpenter but an appeals court overturned that conviction over an issue with the jury selection.
Police were called to the apartment that Warrington and his girlfriend shared back in November of 2012 and found the boy not breathing.
He was taken to Albany Medical Center but later died from a traumatic brain injury.
Warrington was found guilty of murder in July 2013 but an appelate court decided the judge made an error in not dismissing a juror who said she couldn’t be impartial.
