TROY, N.Y. (NEWS10) — The officer accused of killing Edson Thevenin wants the lawsuit filed against him and the city, thrown out.

The motion denies wrongdoing by the police department in connection with the shooting death of Thevenin, after police say he used his car to pin Officer Randy French during a pursuit in April.

They denied nearly all of the 77 counts filed against them in September.

The original motion, filed by Thevenin’s wife Cinthia, claims the City of Troy and the police department violated civil rights including assault and battery.
