TROY, N.Y. (NEWS10) – Jacob Heimroth’s Defense Attorney Joseph Ahearn is alleging that the district attorney’s office elicited false sworn testimony from a key witness in the trial.
Heimroth was scheduled to be sentenced last week for brutally killing Allen and Maria Lockrow in their Lansingburgh home in August 2014.
Prior to sentencing, Ahearn says he found out that witness Laurie Rist, Lockrow’s next door neighbor, is the mother of Justine Rist who is facing robbery charges and being prosecuted by the Rensselaer DA’s office. His case is still pending before the Rensselaer County District Attorney’s office.
The defense says prosecutors needed to release that information before Heimroth’s August trial.
The Assistant DA Andrew Botts says he wasn’t aware that his office was prosecuting Rist, even though his signature was at the bottom of a grand jury notice.
District Attorney Joel Abelove argues his office didn’t know about the relationship between their witness, and a suspect in one of their other pending cases.
Abelove has until the end of the day on Thursday to respond to the defense’s motion.
A judge can then decide whether to let the conviction stand or declare a mistrial.
Another man, Daniel Reuter, has already been sentenced to 40 years for his role in the Lockrow murders.
