SCHENECTADY, N.Y. (NEWS10) – The lawyer for a woman who pleaded guilty to lying about a fire that killed several of her children and their father is asking for less time behind bars.
Jennica Duell’s lawyer is asking for her to be sentenced to only five years in prison with credit for time already served.
In court documents, her lawyer wrote that Edward Leon, also accused of perjury in the case, was sentenced to 10 years. The lawyer argues that Duell should not be punished more severely than Leon.
The prosecution is asking for 15 years in Duell’s case.
The 2013 arson took place on Hulett Street in Schenectady. It killed three of Duell’s children and their father. It also seriously injured the sole survivor and Duell’s other daughter, Safyre Terry.
Duell is scheduled to be sentenced on September 12.
