Man charged with DWI after changing flat tire in Saratoga

SARATOGA, N.Y. (NEWS10) – Police say a man changing a flat tire has been charged with DWI.

Authorities say on Saturday morning around 5:30 a.m. officers were called to Route 50 for a two car accident with injuries. It took place between Veteran’s Way and Exit 15 in the northbound lane.

Officers arrived and located a maroon 2012 Chrysler off on the right shoulder with significant rear end damage and a red 2014 Honda Accord over in the on-coming lanes of traffic with significant front end damage.

Officials say the Chrysler had initially been pulled over to the right side after getting a flat tire. The driver, 22-year-old Spencer Kilburn of Gansevoort, and a passenger were changing the tire when their car was hit from behind by the Honda.

The Honda then came to rest in the oncoming lanes of traffic. The driver of that car, 27-year-old Joshua Noll of Gansevoort, was seen by witnesses running up a grass embankment and into a neighborhood.

There was a male passenger in Noll’s car that sustained internal injuries from the accident. He was transported to Albany Medical Center by Saratoga Springs Fire for emergency medical treatment. At last check police say he was stable after surgery.

Officers checked the surrounding area afterwards and located Noll. He was taken into custody.

Kilburn, the man changing his tire, was charged with DWI after further investigation into the events surrounding the accident. He was released to a third party after processing.

Noll was arraigned and committed to Saratoga County Jail on $10,000 cash/ $20,000 bond. He’s been charged with vehicular assault, felony DWI and leaving the scene of an accident.

Kilburn and his passenger did not sustain any reported injuries. Noll sustained some minor lacerations.
