ROTTERDAM, NY (NEWS10) – A yard collection waste service fee has already been delivered to those who live in the Town of Rotterdam. You do have some options. You can either opt in or if you flip it over, you have to fill out the back to opt out of the service.
“I don’t have a problem that they want 40, 50 100 bucks for it.You want to purchase something, it’s your free will to do so. Telling me that if I don’t send that in, you’re going to bill me anyway is where it gets to be illegal, “said Evan Calarco.
Evan Calarco has lived in Rotterdam for close to ten years.
“It’s bothered me for a while,” said Calarco.
He said he’s upset by the yard waste collection service fee the town has in place, which is a service to pick up leaves and brush.
This is a $40 fee which toy can choose to accept or opt out of. But if you don’t check yes or no, you will get billed anyway.
“Mandating that you have to respond to not sign up for something is illegal on an optional service. It’s not a tax,” said Calarco.
If people don’t in the form saying they want to opt out, they’re still going to be billed the $40.
“That’s correct. That’s the way the law is set up,” said Town Supervisor Steven Tommasone.
Tommasone said the yard fee has been around for years. He has been working to eliminate this fee.
“The fee will be eliminated completely in 2018. But, at this point the fee itself and the revenue for that fee is already engrained in the town budget for 2016 and for 2017 for us to ensure that we don’t exceed the tax cap,” said Tommasone.
Tommasone said everyone understands the frustration.
“We hear it, but at the same time we have to be responsible for everyone,” said Tommasone.
