ALBANY, NY (NEWS10) – District Attorney David Soares announced today that 39-year-old Gavin Thomas, of Albany, was found guilty after a jury trial.
Thomas was found guilty of two counts of criminal possession of a weapon in the second degree, both Class C armed felonies, and one count of criminal possession of a weapon in the third degree, a Class D felony.
On September 22nd of 2014, at around 8:13 P.M. in the area of 202 Jefferson Street in Albany, Thomas possessed two loaded firearms.
One was a Taurus .38 5-shot revolver and a HK USP .40 Smith and Wesson handgun. The Smith and Wesson had the serial number scratched out.
Gavin Thomas will face up to fifteen years in State Prison when he is sentenced November 19th, 2015.
“It seems every week we awaken to news of mass shootings and other reports of gun violence. Illegal guns and the people that carry them pose a clear and present danger to all of us,” DA Soares said. “While our collective attention is now on Oregon, cases like that of Mr. Thomas should serve as a reminder that illegal guns are everywhere and in the hands of those unworthy of the privilege.”
Assistant DA Steven Sharp of the Street Crimes Unit is prosecuting this case.
