Botox maker appeals $6.75M verdict in cerebral palsy case

BURLINGTON, Vt. (AP) – The maker of Botox has appealed a $6.75 million verdict in the case of a couple who said Botox treatment of their son’s cerebral palsy left him with life-threatening complications.

The Burlington Free Press reports the appeal by Allergan Inc. to the 2nd U.S. Circuit Court of Appeals comes a few weeks after a Vermont judge upheld the jury’s decision.

A lawyer for Lori and Kevin Drake of Mineville, New York, said Joshua Drake, now 7, suffered spasms due to mild cerebral palsy until he got Botox injections at a Burlington hospital in 2012. Ray Chester said Joshua has since developed epilepsy and has an aide with him in case he needs life-saving medications during a seizure.

Allergan sought a new trial, saying the family failed to prove Botox caused the seizures.
