Troy man pleads guilty to DWI, crashing into parked car

ALBANY, N.Y. – A Troy man has pleaded guilty to felony DWI for a June 2014 incident.


Nelson Rubio, 24, pleaded guilty in Albany County Court Thursday morning.

On June 21, around 4 a.m., an Albany Police Officer witnesses Rubio crash into a parked car near the intersection of James Street and Columbia Street in the City of Albany.  

The car fled the scene but officers pursued and were able to conduct a traffic stop several blocks away. 

Police determined that Rubio was operating the vehicle and detected the odor of alcohol coming from the vehicle. The man failed every sobriety test that police conducted, displayed watery eyes and slurred speech, and admitted to drinking alcohol before driving the vehicle. However, he refused to submit to a chemical breath test.

At the time of the crash Rubio’s driver’s license was suspended for a 2011 DWI conviction. Rubio also has a 2010 DWI conviction from another county.

Rubio faces up to four and a half years in State Prison when sentenced on September 18.
