Trial continues for man accused of hitting, killing bicyclist

ALBANY, N.Y. — The trial for the Schenectady man accused of hitting and killing a bicyclist, and then leading police on a chase continues Thursday.

The prosecution and defense paint different pictures of what exactly happened on the day of the accident.

Prosecutors told the jury that Pablo Cruz was driving drunk and speeding when he slammed into 45-year old Paul Merges who was riding his bike back in November of 2012. They say Cruz kept driving while Merges was pinned to his car.

According to the defense, Merges wasn’t riding in the marked bike lanes and they say there is no way Cruz could have seen him.

On Thursday, the prosecution will continue to call witnesses to the stand.
