Rensselaer officer faces additional charges in DWI crash

EAST GREENBUSH, N.Y. – The East Greenbush Police Department has filed
additional charges against 22-year-old Mark R. Fusco, a Rensselaer Police
officer accused of causing a deadly crash while under the influence.

Fusco was arrested at the hospital after the crash and
charged with Driving While Intoxicated, Speed Not Reasonable or Prudent, and
Failure to Stay in Designated Lane. According to Rich
McNally, Rensselaer County District Attorney, East Greenbush police have
now added Aggravated Vehicular Homicide, Aggravated DWI, and Manslaughter.

The accident occurred around 5 a.m. Wednesday morning on Third Avenue
Extension at the Rensselaer City Line near the intersection of Grove Street.
Police received multiple calls of a car which struck a tree.

Upon arrival, police found a wrecked 2012 Volkswagen. The male passenger,
22-year-old Sean Murphy of Slingerlands, had been ejected from the car and was
pronounced dead at the scene.

Fusco was removed by ambulance to Albany Medical Center Hospital with
multiple injuries after the accident. McNally says he has been moved from the hospital to a mental
health facility where medical and mental health issues are being addressed for
the time being.  

Tests show his blood alcohol content was more than twice the legal limit at
.20.

Fusco is the son of the Rensselaer Police Department's Chief Rick Fusco, and
had recently been hired as a police officer with the Rensselaer Police
Department.

McNally says officers will sit down with the Murphy family in the next week to
go over the investigation and accident reconstruction.
