Attorneys: Indictment against Bruno is “fatally flawed”

ALBANY, N.Y. – Attorneys for former State Senator Joe Bruno filed a motion to drop charges against their client Thursday saying the government took too long for the newest indictment in the “fatally flawed” case.

The latest indictment contains federal fraud and bribery charges handed up against Bruno, 83, last May, three years after being convicted of honest fraud services.

Last year, part of the conviction against Bruno was overturned due to a Supreme Court ruling saying there had to be an actual bribe or kickback, and there was none. 

But Bruno's attorneys say the statute of limitations has passed for the alleged crimes in the new indictment.

The U.S. Attorney's Office has one month to respond to the motion, and if the defense's request fails, the 83-year-old former State Senate Majority Leader will be back in the court room once again come February.
