ALBANY, NY – The owner of Saratoga Winners Akiva Daniel
Abraham began his prison term on Friday for arson fraud.
In April 2009, Abraham intentionally set fire at Saratoga Winners
in Colonie. Abraham then filed a Property Loss Notice in an attempt to obtain
insurance proceeds in excess of $380,000, when he knew the property was
destroyed by arson.
In August 2010, Abraham was found guilty after a trial of
one count of Insurance Fraud 2nd Degree, a Class C Felony. He
received a sentence of four to 12 years in State Prison.
Abraham tried to appeal the case, contending that there was
not enough evidence to determine he was guilty. However his arguments were
rejected, holding that the evidence was legally sufficient.
Abraham has been out on bail pending appeal. On Friday he
began his prison term.
