Three teens arrested in killing of UAlbany student Richard Bailey

ALBANY — Three teenagers have been arrested in connection with the 2008 murder of UAlbany senior Richard Bailey; 17-year-old Jamell “King” Modest of Albany, 18-year-old Devon Callicutt of Rensselaer and 19-year-old Ricardo Caldwell of Schenectady.

22-year-old Bailey, originally from Wantagh in Long Island's Nassau County, was shot in the head on Albany's South Lake Avenue near Yates Street in late October 2008.

Bailey's parents were in court Monday as the three men accused in the student's killing stood before an Albany County Court judge and heard the charges against them.

Modest and Caldwell were both charged with murder in the second degree. Modest has also been charged with attempted robbery and Caldwell with robbery.

Callicutt, who is currently in state prison on an unrelated crime, is the accused shooter. He is now charged with murder in the first.

Police say the crime was a robbery gone wrong. Richard Bailey fought back and in the end was fatally shot.

Moses Kashi, who lives near the scene of the Bailey killing, said the arrests bring a sense of relief back to the streets. He tells NEWS10, “I'm just glad, glad that it's over with. I don't want to see anybody get hurt in this community like that.”

Bailey's parents are also pleased with the arrest. At Monday's news conference, father James Bailey said “It's never going to bring Rick back, but I don't know that the right word is closure, but we are just so happy this day has finally come.”
